mSeer's Privacy Policy

mSeer, Inc. ("mSEER") values the privacy of our customers, users, and others who use the mobile phone software application (See-Fi™), www.mSeer.com, www.See-Fi.com, www.See-Fi.mobi and other web sites, services, applications, and content (e.g., widgets, feeds, and applications) owned or operated by mSEER, (the "mSEER SERVICES") (such customers or users, collectively or individually, "Users"). This Privacy Policy governs the mSEER SERVICES. This Privacy Policy forms part of the Terms of Use, which are binding on you and are available at http://www.mSeer.com/terms.html. If you download or use See-Fi, you agree to be bound by the See-Fi software end-user license agreement, available at http://www.mSeer.com/EULA.html

The great majority of our Users will use the mSEER Services for harmless business and social purposes. Please be aware mSEER SERVICES enables you to share your mobile phone calendar and/or other information stored on your mobile phones with your designated contacts (See-Fi Peers). By using mSEER SERVICES you will be exposing mobile phone content stored on your mobile phone and you will be allowing See-Fi Peers to access and/or modify your mobile phone content. Please be aware that anyone who has your information (mobile phone number, name, etc.) can assign you as their See-Fi Peers in mSEER SERVICES, and by doing so, your mobile phone content will be available for them to read and/or modify. Please note that by its very nature, your mobile phone content information, is subject to abuse, misuse, and over-monitoring of your schedule by others including, perhaps, by your customers, colleagues, business affiliates, friends, family, or acquaintances. Please use caution and monitor the usage on an ongoing basis. Please consider carefully before disclosing any personal information or data that might be accessible to others. Please be aware that any personally identifiable information that you voluntarily disclose online (www.mSeer.com, www.See-Fi.com, www.See-Fi.mobi ) becomes publicly available and can be read, collected, and used by others and could be used to send you unsolicited messages. mSEER is not responsible for the personally identifiable, information that you choose to disclose publicly on mSEER SERVICES.

Please be aware that any personally identifiable information about you and your designated contacts that you disclose during See-Fi installation or while using See-Fi will be stored locally on your mobile phone. See-Fi is a pure peer-to-peer application and information created or maintained by See-Fi is not stored on any server. mSEER does not maintain or control any information stored or maintained on your mobile phone by See-Fi. Personally identifiable information such as your name that you enter during See-Fi Setup and your mobile phone number will be sent to your designated contacts, and this personally identifiable information will be used when you interact with your See-Fi Peers using See-Fi.

GENERAL INFORMATION: All text messages sent/received by See-Fi must be sent through your mobile carrier's network and your carrier may have access to it. For information regarding your carrier's treatment of your information, please consult your carrier's privacy policies. This Privacy Policy details important information regarding the use and disclosure of User information collected through the mSEER SERVICES. mSEER provides this Privacy Policy to help you make an informed decision about whether to use or continue using the mSEER SERVICES This Privacy Policy is incorporated into and is subject to the mSEER Terms of Use. Your use of the mSEER SERVICES and any personal information you provide on the mSEER SERVICES remains subject to the terms of this Privacy Policy and the Terms of Use.

IMPORTANT DISCLOSURES AND CONSENTS: Data and messaging (including SMS text messages) plans are required to use the mSEER SERVICES. See-Fi requires the use of SMS text messages. Standard messaging and/or data charges, fees, and taxes from your carrier apply.

INFORMATION mSEER COLLECTS:

• Some of our website pages utilize "cookies" and other tracking technologies. A "cookie" is a small text file that may be used, for example, to collect information about Site activity. Some cookies and other technologies may serve to recall Personal Information previously indicated by a Site user. Most browsers allow you to control cookies, including whether or not to accept them and how to remove them. You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser, but please note that if you choose to erase or block your cookies, you will need to re-enter certain identifying information, should we in the future require such information, to gain access to certain parts of the Site. Tracking technologies may record information such as Internet domain and host names; Internet protocol (IP) addresses; browser software and operating system types; clickstream patterns; and dates and times that our Site is accessed. Our use of cookies and other tracking technologies allows us to improve our Site and your web experience.
• Your Name: You provide your name during See-Fi installation Setup procedure. We do not track or store or maintain your name and/or mobile phone number that you provide during See-Fi installation or usage on our systems. This information is stored locally on your mobile phone by See-Fi.
• 'Save & Invite' or 'Invite Now': When you add your designated contact to See-Fi as a See-Fi Peer, See-Fi will ask you for your contact's mobile phone number and name. If you provide a contact's mobile phone number, then See-Fi will automatically send text messages inviting your contact to install See-Fi. When you interact with your contacts using See-Fi, your mobile phone number and your name will be sent to your contacts. Your contact's mobile phone number and name will be stored locally on your mobile phone by See-Fi. We do not store or maintain this information on our servers.

YOUR CHOICES: You may choose whether or not to provide Personal Information to mSEER. The notices we publish on our website whether mSEER collects Personal Information on the website should help you to make this choice. If you choose not to provide the Personal Information we request, you can still visit most of our websites, but you may be unable to access certain options, offers, and services that involve our interaction with you. You can change your See-Fi settings on your mobile phone. You may, for example, block or delete particular designated contacts (See-Fi Peers) on your mobile phone through See-Fi interface. You can uninstall See-Fi at any time on your mobile phone. When you uninstall the See-Fi software, all related materials and information will also be deleted.

OUR COMMITMENT: We are committed to protecting your privacy. Protecting your privacy online or on the mobile phone is an evolving area, and mSEER SERVICES are constantly evolving to meet these demands. THIRD-PARTY ADVERTISERS AND AD-SERVING COMPANIES: Advertisements that appear on mSEER SERVICES are sometimes delivered (or "served") directly to Users by third-party advertisers or ad network companies. These companies may automatically receive your IP address or other information about your mobile phone or personal computer when serving advertisements. These third parties may also download cookies to your computer or mobile phone, or use other technologies such as JavaScript and "web beacons" (also known as "1x1 gifs") to measure the effectiveness of the advertisements served and to personalize advertising content. Doing this allows the advertiser or ad network to recognize your computer or mobile device each time they send you an advertisement in order to measure the effectiveness of the ad and to personalize advertising content. These companies may compile information about the sites or services visited when seeing advertisements and determine which advertisements are clicked. mSEER does not access or have control of the cookies that may be placed by third-party advertisers or ad networks. Likewise, third party advertisers and ad networks do not have access to your personal information, if any, stored with mSEER unless you choose to share it with them. This Privacy Notice does not cover the use of tracking technologies or personal data by any such third-party advertisers or ad networks.

LINKS TO OTHER SITES: Our websites may contain links to other sites. Other sites may also reference or link to our site. We are not responsible for the privacy practices or the content of such other sites.

IN THE EVENT OF MERGER, SALE OR BANKRUPTCY: In the event that mSEER is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from our Users as part of such merger, acquisition, sale, or other change of control so that the mSEER can continue operations. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used. Any such change in ownership or control of your personally identifiable information will be published on our website.

CHANGES AND UPDATES TO THIS PRIVACY POLICY: This Privacy Notice may be revised periodically without further notice to you and this will be reflected by the "last modified" notice below. Please revisit this page to stay aware of any changes. In general, we only use your personal information in the manner described in the Privacy Notice in effect when we received that personal information.
